Terms and Conditions

These Terms and Conditions ("Terms") govern your use of Kassly, a point-of-sale and business management platform operated by Symflo. By creating an account or using the Kassly app or website, you agree to be bound by these Terms.
1. Use of Service
Kassly is a business tool intended for use by retailers, restaurants, and service businesses. You must be at least 18 years old and have legal authority to operate a business to use this service. You are responsible for ensuring that all users under your account comply with these Terms.
2. Account Responsibilities
- You are responsible for maintaining the security of your account credentials.
- You must provide accurate and complete information during registration.
- You must promptly notify us of any unauthorized access to your account.
- You are responsible for all activity that occurs under your account.
3. Acceptable Use
You agree not to use Kassly to:
- Conduct or facilitate any unlawful activity
- Process fraudulent transactions
- Violate any applicable local, national, or international law or regulation
- Interfere with or disrupt the integrity or performance of the service
- Attempt to gain unauthorized access to any part of the service or its related systems
4. Subscription and Billing
Kassly offers a free plan and paid subscriptions, including individual add-ons and curated bundles. Paid subscriptions are billed on a monthly or annual basis depending on your selection. All fees are stated in Philippine Pesos (PHP) unless otherwise indicated, and taxes are applied where applicable.
Authorization to charge, including automatic recurring charges. By subscribing, you authorize Symflo to charge the payment method on file for the applicable fees. If you save a GCash, Maya, or card payment method for automatic payment ("auto-pay"), you further authorize us to charge that saved method automatically on each renewal date, without any further action on your part, until you cancel the subscription or remove the saved payment method.
- Timing and frequency. Charges recur monthly or annually, on the renewal date shown in Settings → Billing. If a charge fails, we may retry it over the following days before treating the subscription as past due.
- How the amount is calculated. Add-ons are priced per branch/location (and per employee for staff or HR add-ons such as Payfolk HR). Bundles are charged at the bundle price per branch. Annual subscriptions are billed as twelve months of the applicable rate, charged once per year. All amounts are in PHP, plus taxes where applicable.
- Refunds. Refunds and prorated credits are governed by our Refund Policy.
- Cancellation and stopping automatic charges. You may cancel any subscription at any time from Settings → Billing; access continues until the end of the period you have already paid for. You may also remove your saved payment method from Settings → Billing at any time to stop automatic charges — your current subscription continues until the end of the paid period.
- Records of consent. We retain electronic records of your acceptance of these Terms and your payment authorization, including a timestamp, so both you and Symflo have a record of the agreement.
We reserve the right to change pricing with at least 30 days' notice. Continued use of the service after a price change constitutes acceptance of the new pricing.
5. Free Plan Accounts
Kassly offers a free plan with limited features and usage caps. Free plan accounts are provided at our discretion and may be subject to additional restrictions. We reserve the right to:
- Suspend or disable free plan accounts that have been inactive for 90 consecutive days or more
- Modify, reduce, or remove free plan features or usage limits at any time with 30 days' notice
- Disable free plan accounts that consume excessive resources or negatively impact service performance for other users
- Discontinue the free plan entirely, in which case we will provide at least 30 days' notice and an opportunity to export your data
Free plan accounts do not carry any service-level guarantees. We may prioritize support and system resources for paid subscribers.
6. Data and Privacy
Your use of Kassly is also governed by our Privacy Policy. You retain ownership of all business data you input into Kassly. By using the service, you grant us a limited license to store, process, and display that data solely to provide the service to you.
7. Availability and Downtime
We strive for high availability but do not guarantee uninterrupted access to the service. Kassly is designed to work offline; however, sync features and cloud-dependent functions require internet connectivity. We are not liable for any losses resulting from service downtime or data sync delays.
8. Termination
You may cancel your account at any time through the app settings or by contacting support. We reserve the right to suspend or terminate accounts that violate these Terms, with or without prior notice. Upon termination, your access to the service will cease and your data will be handled in accordance with our Privacy Policy.
9. Service Discontinuation
In the event that Symflo ceases operations, undergoes bankruptcy, dissolution, or otherwise discontinues the Kassly service, we will make reasonable efforts to:
- Provide at least 30 days' advance notice via email and in-app notification
- Allow you to export your business data in a standard format during the notice period
- Process any outstanding refunds for prepaid subscription periods that extend beyond the discontinuation date
In the event of an acquisition, merger, or sale of assets, your account and data may be transferred to the successor entity, which will be bound by these Terms. If the successor materially changes how your data is used, you will be notified and given the opportunity to delete your account before the changes take effect.
Symflo shall not be liable for any losses or damages arising from service discontinuation, provided the notice and data export obligations described above are met.
10. Kassly Card (Customer App)
Kassly Card is a free companion app for customers of businesses that use Kassly. By creating a Kassly Card account you agree to these Terms; the business-account provisions above (including Sections 1, 4, and 5) do not apply to Kassly Card users. You must be at least 13 years old to use Kassly Card.
- You are responsible for keeping your login credentials secure and for activity under your account.
- You may only link store profiles that belong to you, using the QR code the store provides. Attempting to claim another person's profile, forge or alter QR codes, or gain unauthorized access to any account is prohibited.
- Memberships, loyalty points, visits, and packages shown in the app are records issued, owned, and managed by each individual store. Kassly displays them as provided by the store and is not a party to your transactions with the store — pricing, redemption, expiry, and disputes are between you and the store.
- You may delete your account at any time in the app (Profile → Delete account). We may suspend or terminate accounts that violate these Terms.
11. Disclaimer of Warranties
Kassly is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the service will be error-free, secure, or meet your specific business requirements. Your use of the service is at your own risk.
12. Limitation of Liability
To the fullest extent permitted by law, Symflo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of Kassly, even if we have been advised of the possibility of such damages.
13. Governing Law
These Terms are governed by the laws of the Republic of the Philippines. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in the Philippines.
14. Changes to These Terms
We may update these Terms from time to time. We will notify you of significant changes by email or through an in-app notice. Continued use of the service after changes take effect constitutes your acceptance of the revised Terms.
